Guidry v. Sheet Metal Workers National Pension Fund

In Guidry v. Sheet Metal Workers National Pension Fund, 493 U.S. 365, 107 L. Ed. 2d 782, 110 S. Ct. 680 (1990), the chief executive officer of a union had embezzled union funds, and the union obtained a sizable judgment against him. The union official was eligible to receive benefits under his pension plans, and the union sought to impose a constructive trust on those benefits. The Supreme Court held that ERISA's anti-alienation provision foreclosed that remedy because pension plan rather than welfare plan benefits were at issue. Id. at 376-77.
