The Bremen v. Zapata Off-Shore Co

In The Bremen v. Zapata Off-Shore Co., 407 U.S. 1, 10-11, 15, 92 S. Ct. 1907, 32 L. Ed. 2d 513 (1972) the United States Supreme Court held that forum-selection clauses are enforceable in admiralty cases unless enforcement would be unreasonable under the circumstances or a clause was invalid for reasons such as duress or fraud. The Supreme Court observed that this is the general rule in all kinds of cases in most common-law countries, that it is the rule adopted by the Restatement (Second) of Conflict of Laws, and that it "accords with ancient concepts of freedom of contract".
