Wasman v. U.S

In Wasman v. U.S. (1984), 468 U.S. 559, 104 S.Ct. 3217, 82 L.Ed.2d 424, the court held that where a sentencing judge states his reasons for imposing a more severe sentence, the presumption of vindictiveness is rebutted. Specifically, in Wasman the defendant had a criminal conviction in the interim between his original sentence and his resentencing after retrial. Id. at 569-570.
