Wisconsin Dept. of Indus., Labor & Human Relations v. Gould Inc

In Wisconsin Dept. of Indus., Labor & Human Relations v. Gould Inc., 475 U.S. 282 [1986], the United States Supreme Court reviewed a Wisconsin law that debarred governmental entities from doing business with companies that had violated the National Labor Relations Act three times within five years. The United States Supreme Court found it regulatory and held that it was preempted by federal law. "Debarment . . . serves plainly as a means of enforcing the NLRA." (Gould, 475 U.S. at 287.) The Supreme Court noted that "the point of the statute is to deter labor law violations" and that "no other purpose could credibly be ascribed." (Id. at 287.)
