A.R.S. 9-463.05(A) City Councils Authority

In Arizona, city councils have broad authority to enact, amend or repeal laws that are "necessary or proper" to implement those powers that are granted to them. A.R.S. 9-240(B)(28)(a). By enacting A.R.S. 9-463.05(A), the Arizona Legislature specifically granted municipalities the power to impose development fees. That section provides: A municipality may assess development fees to offset costs to the municipality associated with providing necessary public services to a development, including the costs of infrastructure, improvements, real property, engineering and architectural services, financing, other capital costs and associated appurtenances, equipment, vehicles, furnishings and other personalty.
