Citibank (South Dakota), N.A. v. Phifer

In Citibank (South Dakota), N.A. v. Phifer, 181 Ariz. 5, 6, 887 P.2d 5, 6 (App. 1994), the Court clarified that the filing of the foreign judgment in an Arizona court "does not turn the foreign judgment into a domestic judgment for the purpose of avoiding the statute of limitations applicable to foreign judgments." Id. at 7, 887 P.2d at 7; see also A.R.S. 12-544(3) (requiring that foreign judgments be commenced and prosecuted within four years after the cause of action accrues). When a foreign judgment is timely filed, the UEFJA "gives the clerk the authority to treat that judgment in the same manner as a domestic judgment." Citibank, 181 Ariz. at 7, 887 P.2d at 7.
