Decola v. Freyer

In Decola v. Freyer, 198 Ariz. 28, P 24, 6 P.3d 333, 339 (App. 2000), Division One determined a superior court had discretion to extend a party's time to appeal from an arbitration award "under the rationale of ARCAP 9(a)." The court stated that a party might be entitled to relief in such circumstances if it "failed to receive notice of the filing of the arbitration award, . . . acted diligently, and no prejudice to plaintiff was shown." Id. P 19.
