In Gorney v. Meaney, 214 Ariz. 226, P 16, 150 P.3d 799, 804-05 (App. 2007), the Court affirmed the trial court's grant of summary judgment where the plaintiff had provided an expert opinion affidavit failing to meet the requirements of 12-2603(B). In Gorney, the appellant never contended that summary judgment was an inappropriate remedy for a violation of 12-2603(B). The Court therefore never addressed that question.
