Gorney v. Meaney

In Gorney v. Meaney, 214 Ariz. 226, P 16, 150 P.3d 799, 804-05 (App. 2007), the Court affirmed the trial court's grant of summary judgment where the plaintiff had provided an expert opinion affidavit failing to meet the requirements of 12-2603(B). In Gorney, the appellant never contended that summary judgment was an inappropriate remedy for a violation of 12-2603(B). The Court therefore never addressed that question. Moreover, the plaintiff there had been provided an opportunity to cure his affidavit and had failed to do so before his case was dismissed. Gorney, 214 Ariz. 226, P 3, 150 P.3d at 801
