Guertin v. Pinal County

In Guertin v. Pinal County, 178 Ariz. 610, 875 P.2d 843 (App. 1994), the plaintiff sued Pinal County after the county dismissed him. The plaintiff had unsuccessfully appealed his discharge to the county merit commission, but did not seek judicial review of the adverse decision. Instead, the plaintiff sued Pinal County alleging, inter alia, that he had been wrongfully discharged. The Court found that the plaintiff's wrongful discharge claim was "squarely within the jurisdiction of the county merit system" and that his exclusive remedy was to appeal the decision in accordance with the Administrative Review Act, A.R.S. 12-901 through 12-914. 178 Ariz. at 612, 875 P.2d at 845.
