Matter of Struthers

In Matter of Struthers, 179 Ariz. 216, 222, 877 P.2d 789, 795 (1994), a Disciplinary Commission case, the attorney included a provision in his fee agreement to keep both the court-awarded fees as well as his contingency fee. Referencing 12-341.01(B), Struthers noted that the "purpose of awarding fees to a successful litigant is not to provide the lawyer with a double payment bonus but to defray the client's litigation expenses." Id.
