Spain v. Griffith

In Spain v. Griffith, 42 Ariz. 304, 307, 25 P.2d 551, 552 (1933), the plaintiff sued for damages caused by a bus running into her building. 42 Ariz. at 305, 25 P.2d at 551. Her witnesses testified that the damages were around $4,000. Id. at 306, 25 P.2d at 551. The defendants' witnesses stated that the damages were either $175 or $350. Id. at 306-07, 25 P.2d at 552. The jury awarded damages of $1,708. Id. at 305, 25 P.2d at 551. The supreme court remanded, stating "there was no manner in which it could reconcile the verdict of the jury with the testimony of the witnesses," and, therefore, the verdict was "not supported by any evidence." Id. at 307, 25 P.2d at 552.
