In State v. Williams, 131 Ariz. 211, 213, 639 P. 2d 1036, 1038 (1982) the prior litigation was a probation revocation hearing. 131 Ariz. at 212, 639 P.2d at 1037. The superior court denied revocation because the state did not prove a violation. Id. The defendant was subsequently convicted of sexual assault "which was the basis of the petition to revoke the defendant's probation." Id. at 213, 639 P.2d at 1038. The defendant contended that collateral estoppel barred the sexual assault conviction. Id. The supreme court disagreed, stating that the result of the revocation hearing did not "rise to the respectability of a judgment." Id.
