Supervising Psychiatrist Presence During a Patient Evaluation In Arizona

In In re Maricopa County Superior Court No. MH 2002-000767, 205 Ariz. 296, 69 P.3d 1017 (App. 2003), the court held that, while supervising psychiatrists need not be physically present during the evaluation of the patient and preparation of the affidavit, the statute requires more than just general supervision. Id. at 298, P 10, 69 P.3d at 1019. "The State must be able to show that the supervising psychiatrist actually provided some supervision of the resident in the examination of the patient whose treatment is at issue. " Id. at 300, P 17, 69 P.3d at 1021.
