Washington Elementary Sch. Dist. No. 6 v. Baglino Corp

In Washington Elementary Sch. Dist. No. 6 v. Baglino Corp., 169 Ariz. 58, 60, 817 P.2d 3, 5 (1991), the indemnitor agreed to indemnify against loss caused "in whole or in part by any negligent act or omission of the indemnitor . . . regardless of whether or not it is caused in part by a party indemnified hereunder." The Arizona Supreme Courtheld this language was sufficiently broad to require "coverage for any type of damage caused by the negligent behavior of the indemnitor, even though also caused in part by the active negligence of the party indemnified."
