14859 Moorpark Homeowner's Assn. v. VRT Corp

In 14859 Moorpark Homeowner's Assn. v. VRT Corp. (1998) 63 Cal.App.4th 1396, the court was called upon to decide whether a homeowner's association could convey good title of a condominium complex without a judicial partition. The court held that it could not. But nowhere in Moorpark did the court address the issue of whether the association could "list" the property for sale and whether doing so was an ultra vires act.
