Anaya v. Turk

In Anaya v. Turk (1984) 151 Cal. App. 3d 1092, defendants invited plaintiff and an ex-convict to their apartment where the ex-convict became violent and shot plaintiff and one of the defendants. On appeal the court affirmed summary judgment on plaintiff's theory that defendants had a duty to warn of the other guest's "criminal propensities. " The court held that "as a matter of law defendants' generalized knowledge" of the ex-convict's criminal history could not "be the basis of a finding of foreseeability." ( Id. at p. 1100.)
