Auerbach v. Great Western Bank

In Auerbach v. Great Western Bank (1999) 74 Cal.App.4th 1172, 1190, because the jury had been misled as to the amount of the compensatory damages it could award, the Court of Appeal concluded: "Because the punitive damages are out of proportion to the actual damages suffered by the Auerbachs, the punitive damage claim will have to be retried."
