Aydelott v. Superior Court

In Aydelott v. Superior Court (1970) 7 Cal. App. 3d 718, the defendant was charged with illegally prescribing a narcotic, attempted oral copulation of a minor, contributing to the delinquency of a minor by allowing him to consume alcohol, contributing to the delinquency of a minor by fondling him, and oral copulation of a minor. All counts involved different victims and offense dates. There, the court found that the narcotics charge should have been severed. As to the balance of the counts, however, the court found that the counts were properly joined because they were all committed in the defendant's home, involved male juveniles, and deviate sexual conduct was an element "underlying" three of the counts.
