Barker v. Brown & Williamson Tobacco Corp

In Barker v. Brown & Williamson Tobacco Corp. (2001) 88 Cal. App. 4th 42, the plaintiff brought a wrongful death action against a tobacco company, based on his father's death in 1962 from a tobacco-related illness. The Barker court held that the Legislature intended only to eliminate the tobacco immunity. Nothing in the legislative history or in the language of the amendments indicates an intent to revive claims that are time-barred. ( Id. at p. 49.)
