Boggs v. Boggs

In Boggs v. Boggs (1944) 63 Cal.App.2d 576, the life tenant paid interest and principal that came due on a mortgage on an apartment property and filed a declaratory relief action seeking a determination that the remaindermen were obligated to reimburse her for principal payments she made on the mortgage. The appellate court upheld the trial court's determination that the life tenant was entitled to reimbursement. ( Id. at pp. 579, 585.)
