Budavari v. Barry

In Budavari v. Barry (1986) 176 Cal. App. 3d 849, plaintiff conceded on appeal after the sustaining of a demurrer, that the defendants' failure to detect her husband's lung cancer or to follow up on X-ray findings, at a time when the husband was hospitalized for injuries sustained in an automobile accident, was not an event that could be witnessed.
