Conservatorship of James

In Conservatorship of James (1994) 30 Cal.App.4th 293, the conservatee demanded a hearing on a petition for reappointment of his conservator. Because of a snowstorm, the hearing was delayed until 14 days after his demand. In rejecting the conservatee's claim that the delay divested the court of jurisdiction to hear the petition, the court concluded that the 10-day statutory time limit was directory, not mandatory, because the statute provided no consequence or penalty for failing to comply with the 10-day requirement.
