Crow v. State of California

In Crow v. State of California (1990) 222 Cal.App.3d 192, a college student was attacked inside a dormitory by another student known by the school to have previously assaulted others on campus. The injured student alleged the university dormitory was in a dangerous condition due to the school's failure to control the assailant or warn others about him, and due to the school's failure to secure the dormitories from persons known to be a hazard to other students. ( Id. at pp. 197-198.) The trial court granted summary judgment on the basis the injured student failed to allege any physical defect in the property creating a dangerous condition. We affirmed. ( Crow v. State of California, supra, at p. 198.)
