Echevarrieta v. City of Rancho Palos Verdes

In Echevarrieta v. City of Rancho Palos Verdes (2001) 86 Cal.App.4th 472, the court upheld abatement of a view obstruction pursuant to a city ordinance limiting the height of foliage on residential property. In Echevarrieta, the city issued the plaintiff's neighbor a view restoration permit under a city ordinance limiting the height of foliage on residential property so as to preserve hillside views. The plaintiff petitioned for a writ of mandate challenging the view restoration permit. The trial court denied the plaintiff's petition, and the Court of Appeal affirmed. The trial court held that the purposes of the ordinance restricting the height of foliage represented a legitimate exercise of the city's police power and did not violate the plaintiff's due process rights.
