In Estate of McGirl (1932) 125 Cal.App. 310, a codicil to decedent's will called for a monthly payment to an individual. The trial court ordered the payment and the appellate court reversed. The appellate court held that there was no evidence in the record to support a finding or implied finding that the executor had in his possession the funds needed to comply with the order.
