Ferdin v. Superior Court

In Ferdin v. Superior Court (1974) 36 Cal. App. 3d 774, officers had evidence of ongoing drug operation out of Ferdin's residence based in part on the admission of his runner, Garcia, who had been arrested with heroin in his car obtained that day from Ferdin. (Ferdin, supra, 36 Cal. App. 3d at p. 778.) After police knocked on Ferdin's door the evening of Garcia's arrest, the door was partly opened, police identified themselves, and the door was then shut. (Ibid.) The court of appeal found the combination of circumstances justified the officers' entry to secure the residence based on the danger Garcia's arrest would become known to Ferdin and evidence destroyed. (Id. at p. 781.)
