Foge v. Schmidt

In Foge v. Schmidt (1951) 101 Cal.App.2d 681, the trustee refused to grant the trustor's agents a 10-15 minute delay to obtain cash and bought the property himself for less than the trustor's agents had bid and far less than the actual value of the property. The court thus invoked the established rule that gross inadequacy of price coupled with even slight additional evidence of unfairness justifies setting aside a trustee's sale. ( Id. at p. 683.)
