Furda v. Superior Court

In Furda v. Superior Court (1984) 161 Cal. App. 3d 418, the court determined the forum selection clause to be enforceable and granted the defendant's petition for a writ of mandate to order the Orange County Superior Court to stay the action pending final determination of any actions against the defendant in Michigan. Again almost identical to the clause presented in this case, the forum selection clause in Furda provided: "Any controversy or claim arising out of or relating to this Agreement . . . shall be litigated in Michigan."
