Gibson v. Thrifty Drug Co

In Gibson v. Thrifty Drug Co. (1959) 173 Cal.App.2d 554, the court held that the plaintiff was not entitled to recover from the losing defendant jury fees that had been paid by the prevailing defendant. (Id. at p. 556.) But as the court explained, "had the plaintiff paid the entire jury fees she would have been entitled to those as against" the losing defendant. (Ibid.) Our case is factually distinguishable. In Gibson, the prevailing plaintiff had not paid the claimed fees. (Ibid.)
