Gion v. City of Santa Cruz

In Gion v. City of Santa Cruz (1970) 2 Cal.3d 29, the Court held that if a property owner allows uninterrupted public use of the property for a period of five years or more without objection or interference, and if the persons using the property do so under the belief it is public land, the law will imply that the owner has dedicated the land or an easement therein to public use.
