Giovannoni v. Giovannoni

In Giovannoni v. Giovannoni (1981) 122 Cal. App. 3d 666, the parties knew of the pension and had at one time asserted it to be an asset subject to disposition by the court as either community or separate property. However, by the time the court entered judgment, the pension had been withdrawn from the court's consideration by mutual agreement of the parties. The Giovannoni court held "the court was not called upon to award it, and did not award it, as community property, separate property, or any property at all." (Id. at p. 672.)
