Green v. Bristol Myers Co

In Green v. Bristol Myers Co. (1988) 206 Cal. App. 3d 604, the court decided the 30-day period should run not from the initial trial date, as in the discovery cutoff, but from the trial date in effect when the motion was noticed. (Id. at p. 609.) The Green court rested its conclusion not only on the plain language of the summary judgment statute, but also on the policy of permitting meritorious summary judgment motions to be heard in order to dispose of baseless claims.
