Grobeson v. City of Los Angeles

In Grobeson v. City of Los Angeles (2010) 190 Cal.App.4th 778, the plaintiff supported his new trial motion with a declaration stating that during the trial, a juror said, "'I made up my mind already. I'm not going to listen to the rest of the stupid argument.'" (Grobeson, 190 Cal.App.4th at p. 784.) The same juror submitted a declaration in which she denied making those remarks. (Ibid.) The appellate court affirmed trial court's grant of a new trial, concluding the record established juror bias. (Id. at pp. 786-796.)
