Haywood v. American River Fire Protection

In Haywood v. American River Fire Protection (1998) 67 Cal.App.4th 1292, the disciplinary measures themselves were the cause of the emotional stress for which the firefighter was seeking disability retirement. ( Id. at pp. 1297-1299.) Concluding that Haywood was not entitled to disability retirement benefits, the Haywood court specifically noted the firefighter's "claim for disability retirement assumes that he is entitled to disability retirement despite his termination for cause unrelated to his alleged medical condition." ( Id. at p. 1306.) The Haywood court further observed that ". . . where, as here, an employee is fired for cause and the discharge is neither the ultimate result of a disabling medical condition nor preemptive of an otherwise valid claim for disability retirement, the termination of the employment relationship renders the employee ineligible for disability retirement regardless of whether a timely application is filed." ( Id. at p. 1307.)
