Hoffman Street, LLC v. City of West Hollywood

In Hoffman Street, LLC v. City of West Hollywood (2009) 179 Cal.App.4th 754, the challenge was to a Planning and Zoning Law section concerning the city council's extension of an interim ordinance, a legislative act. The Hoffman Street, LLC court found in favor of the petitioners on the ground that under the applicable Government Code section, the city was required to make the findings set forth in the statute and did not do so. In so holding, the appellate court mentioned in a footnote that the trial court had erred in finding that the petitioners failed to exhaust their administrative remedies. (Hoffman Street, LLC v.
