Hotz v. Rich

In Hotz v. Rich (1992) 4 Cal.App.4th 1048, the Court of Appeal considered the federally protected right of amateur radio operators to erect aerials, and the right of the property owners to enforce restrictive covenants to bar them. It adopted a balancing test between the radio operator's rights and the impact on neighboring properties, property values and "any aesthetic and safety" issues. (Id., at p. 1057.)
