Hyman v. Gordon

In Hyman v. Gordon (1973) 35 Cal.App.3d 769, it was further held a homebuilder may be held strictly liable "where, as the proximate result of a defect in the design of a residential building, and installation of an article pursuant thereto, injury results to a human being." ( Id., at p. 773.) The court stressed that "it is possible that an article . . . may function safely in one location in the design but not another." (Ibid.)
