In In re Frankie J

In In re Frankie J. (1988) 198 Cal. App. 3d 1149, the minor and codefendant assaulted the victim and told her they were going to kill her. After she was beaten and raped, the victim heard the codefendant tell the minor to give him the knife. When the minor replied he did not have it, the codefendant told him to go home and get it. Before the minor returned on his bicycle, the victim escaped. Although the knife was not used during the commission of the offense, the court held there was "substantial evidence the use of a weapon was contemplated" and therefore bore a "'reasonable relationship to the crime he committed and to preventing future criminality.'
