In re A.G

In In re A.G. (2013) 220 Cal.App.4th 675, the mother had serious mental health issues and was living with the father and the minors at the time of the hearing. The father had hired a nanny to watch the minors when the mother was home and he was not. The Court held in that factual setting, where the minor was not in danger and given scarce public resources better put to exercising jurisdiction over neglected or abused children, the issue of custody should be resolved in the family court. Indeed, the Court remanded the case to the family court for a hearing on custody and visitation. (A.G., at pp. 686--687.)
