In re Amber B

In In re Amber B. (1987) 191 Cal. App. 3d 682, the court reversed a dependency order because the juvenile court admitted unproven scientific testimony. (Id. at p. 691.) A child psychologist observed a minor child playing with anatomically correct dolls. Based on her aggressive sexualized play, he formed the opinion the child had been sexually molested. As the court there noted, "The purpose of the Kelly-Frye test is to prevent factfinders from being misled by the 'aura of infallibility' that may surround unproven scientific methods. " (Id. at p. 686.)
