In re Barton

In In re Barton (1959) 168 Cal. App. 2d 584, the parent originally signed a consent for the purpose of care, pursuant to which the child was placed in the custody of the couple who eventually adopted the child. ( Id. at p. 586.) After the court issued letters of guardianship until the petition for adoption was filed, a period of 13 months, the mother failed to communicate with the child. ( Id. at p. 589.) The court based its holding on In re Maxwell, which the court found had "clearly established that the intent to abandon may be shown by proof of the parent's failure to provide support or attempt to communicate with the child for a period of one year after the legal change of custody." ( In re Barton, supra, at pp. 587-588.)
