In re Binh L

In In re Binh L. (1992) 5 Cal.App.4th 194, the Court stated that, " 'The application of the Fourth Amendment depends on whether the person invoking its protection can claim a "justifiable," a "reasonable," or a "legitimate expectation of privacy" that has been invaded by government action. ' This principle 'posits a two-part inquiry: first, has the individual manifested a subjective expectation of privacy in the object of the challenged search? Second, is society willing to recognize that expectation as reasonable?' " (Id. at p. 201.)
