In In re Brendan P. (1986) 184 Cal. App. 3d 910, the court rejected the department's argument that the appellant had waived a claim of inadequate notice because neither appellant nor his counsel objected on that ground in the trial court. ( Id. at p. 916.) However, there, at the hearing at issue, "the father was treated as a nonparty to the proceeding; and his attorney, unfamiliar with juvenile court procedure and having no notice of the hearing, did not then know the precise steps to be taken." (Ibid.)
