In re Daniel K

In In re Daniel K. (1998) 61 Cal.App.4th 661, the mother challenged the juvenile court's denial of her discovery request in an appeal from an order denying her section 388 petition for modification. The Court stated: "Section 395 provides in pertinent part: 'A judgment in a proceeding under Section 300 may be appealed from in the same manner as any final judgment, and any subsequent order may be appealed from as an order after judgment. . . .' In a section 300 proceeding, the order entered at the dispositional hearing is a final judgment, and any order entered after the dispositional hearing (with one exception not pertinent here) is appealable as an order after judgment. . . . The notice of appeal must be filed within 60 days after the juvenile court makes a final appealable order. (Cal. Rules of Court, rule 1435(f).)" (In re Daniel K., supra, 61 Cal.App.4th 661, 666-667.)
