In re Josue S

In In re Josue S. (1999) 72 Cal.App.4th 168, appellant claimed that "the trial court improperly imposed probation conditions that have no reasonable relationship to the facts underlying the wardship order and his personal history. . . . He further argues that the conditions of probation restrict his constitutional rights." ( Id. at pp. 169-170.) The court in Josue S. relied heavily on the doctrine articulated in People v. Welch (1993) which, as discussed above, only precluded reasonableness challenges. The conditions challenged in Josue S. are dissimilar to those challenged in the present case: "minor objects to . . . warrantless searches; . . . restrictions on travel; . . . maintenance of satisfactory school grades." (Ibid.)
