In re Marriage of Green

In In re Marriage of Green (1989) 213 Cal. App. 3d 14, the court affirmed a judgment of dissolution of marriage notwithstanding the husband's appeal. The court also awarded the wife appellate attorney fees under former section 4370.5 of the Civil Code, the predecessor provision to section 271. ( Id. at pp. 27-28.) The appellant husband was an attorney who had filed dozens of appeals and had violated numerous rules governing appeals. ( Id. at pp. 28-29.) The Green court determined that the husband had "consistently attempted to frustrate the policy of the law . . . to promote settlement of litigation, reduce costs, and encourage cooperation between the parties." ( Id. at p. 29.)
