Jones v. Superior Court

In Jones v. Superior Court (1970) 3 Cal.3d 734, the California Supreme Court determined, in reviewing a pretrial request to dismiss a heroin sale prosecution, that actual prejudice existed because during the lengthy precharging delay, the defendant had no way to prepare for a defense to a future prosecution because he "did not know when or how the police believed the crime was committed." (Id. at p. 741.)
