Kachadoorian v. Calwa County Water Dist

In Kachadoorian v. Calwa County Water Dist. (1979) 96 Cal. App. 3d 741, the court held that when an alleyway under which a public utility had maintained a water pipeline was abandoned, the alleyway easement was terminated. However, 50 years of use of that pipeline as a part of a community water system was sufficient to establish the necessity of maintaining the pipeline use and thus to prevent the property owner from quieting title or seeking injunctive relief. The owner could seek damages as to the public pipeline easement only on the theory of inverse condemnation.
