Kinder v. Pacific Public Carriers Co-op, Inc

In Kinder v. Pacific Public Carriers Co-op, Inc. (1980) 105 Cal. App. 3d 657, the Insurance Commissioner was directed to liquidate the assets of an insurance company, and the requisite notice was made by publication. ( Id. at pp. 659-660.) After the claims bar date, an individual previously unknown to the Insurance Commissioner inquired about the proceedings and eventually submitted a claim. ( Id. at pp. 661, 664.) The Insurance Commissioner denied the claim as untimely. ( Id. at p. 661.) On appeal, the individual argued that notice by publication denied her due process of law. ( Id. at p. 664.) The court in Kinder rejected this contention, reasoning that such notice was proper in the circumstances. ( Id. at pp. 664-665.)
