Lodi v. Lodi

In Lodi v. Lodi (1985) 173 Cal.App.3d 628, plaintiff and defendant were the same person; plaintiff sued himself to quiet title. When plaintiff failed to answer his complaint, he requested entry of judgment. (Lodi v. Lodi, supra, 173 Cal.App.3d at p. 630.) The trial court, on its own motion, struck the complaint, because the complaint failed to state facts constituting a cause of action, as required by section 425.10. "Consequently, the complaint was not drawn in conformity with the laws of this state and was thus properly subject to the court's own motion to strike under section 436 . . . ." (Lodi, at p. 631.)
